Terms of Service
Effective Date: March 21, 2026. Welcome to goldandsilveraccount.com (the “Site”), operated by Gold and Silver Account  (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site, our services for fractional ownership of physical gold and silver, account creation, purchases, storage, buyback, and related features (collectively, the “Services”).By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

1. Eligibility: You must be at least 18 years old and have the legal capacity to enter into contracts to use our Services. By using the Services, you represent and warrant that you meet these requirements. 

2. Account Registration. To access certain Services (e.g., purchasing metals, viewing holdings), you must create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts for violations of these Terms or suspected fraudulent activity.

3. Services Description: Our Services allow you to:

  • Purchase fractional ownership interests in allocated physical gold and silver stored in secure, insured, audited vaults.
  • Start investments from as little as $1 (subject to any minimums we set).
  • View your holdings, transaction history, and account balance.
  • Request buyback of your holdings at prevailing rates (subject to our buyback policy).
  • Potentially request physical delivery (subject to fees, minimums, and availability).

Important: We are not providing investment, financial, tax, or legal advice. Precious metals prices fluctuate; past performance does not guarantee future results. You invest at your own risk.

4. Purchases and Payments

  • All purchases are final unless otherwise stated.
  • Prices are quoted in USD and include any applicable premiums/fees at the time of purchase.
  • We use third-party payment processors (e.g., credit cards, ACH). You agree to their terms and our no-refund policy for completed transactions except in cases of error or as required by law.
  • Ownership of fractional metals is allocated and titled to you upon successful payment and confirmation.

5. Storage and Insurance

  • Your metals are stored in third-party, insured vaults with regular audits for transparency.
  • We (or our partners) maintain insurance coverage against loss, theft, or damage, subject to policy terms.
  • No monthly or annual storage fees apply (as advertised), but other fees (e.g., transaction, delivery) may apply.

6. Buyback and Liquidity

  • We offer buyback of your holdings at competitive market rates, minus any applicable spread or fees.
  • Buyback is subject to availability, verification, and our discretion.
  • We are not obligated to repurchase at any specific price or time.

7. Fees
We strive for transparency with no hidden storage fees. Other potential fees include:

  • Transaction or processing fees.
  • Delivery/shipping fees (if physical redemption requested).
  • Any applicable taxes.

Current fees are displayed during transactions or in your account dashboard.
8. Prohibited Conduct You agree not to:

  • Use the Services for illegal purposes.
  • Attempt to interfere with, hack, or reverse-engineer the Site.
  • Misrepresent your identity or provide false information.
  • Harass, spam, or abuse others.

9. Intellectual Property. All content on the Site (text, logos, designs) is owned by us or our licensors. You may not copy, modify, or distribute without permission. 

10. Disclaimers and Limitation of Liability THE SERVICES AND SITE ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification You agree to indemnify and hold us harmless from claims arising from your violation of these Terms, misuse of the Services, or infringement of third-party rights.

12. Termination. We may terminate or suspend your access at any time for any reason, including violations of these Terms. Upon termination, your right to use the Services ends, but Sections 9–14 survive. 

13. Governing Law and Dispute Resolution: These Terms are governed by the laws of [Your State, e.g., Delaware or Wyoming], without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in [Your County/City, State].
